MILLHISER: Kavanaugh nomination a win for Republicans – and a blow to democracy

On the most controversial issue facing the Supreme Court, abortion, Kavanaugh is all but certain to give conservatives what they want. Just last year, in Garza v. Hargan, Kavanaugh claimed that the Trump administration should be allowed to delay an undocumented minor’s abortion by literally holding them prisoner to prevent them from reaching an abortion clinic. Admittedly, Kavanaugh also said that the government could only delay someone’s abortion temporarily — as a lower court judge, he is bound by precedent saying that the government cannot cut of abortion rights entirely — but if Judge Kavanaugh becomes Justice Kavanaugh, he will be free to overrule those decisions.
